Service Agreement for Plan Management Services
Parties
This agreement is a contract between you (the participant) and Planit Plan Managers (the provider). It represents all the terms and conditions, policies, rights, and responsibilities associated with being a plan management client at Planit. Planit is a registered provider of supports under the National Disability Insurance Scheme (NDIS). Planit is a financial intermediary service that will help you manage your NDIS budget and its outcomes.
NDIS and this Service Agreement
This Service Agreement is made for the purpose of providing services described below under the Participant’s NDIS plan.
This Agreement is made according to the rules and the goals of the National Disabilities Scheme.
The participant and the service provider agree that this agreement is in line with the main ideas of the NDIS. These ideas include choice, achieving goals and taking part in the community.
The Participant or their representative consents to Planit having access to view their NDIS plan on the NDIS portal for the purpose of providing the services described here.
Schedule of Supports
The provider agrees to provide the Participant with supports as set out in the attached Schedule of Supports in accordance with the duration of this agreement.
The supports and their prices are set out in the attached Schedule of Supports. All prices are GST inclusive (if applicable) and include the cost of providing the supports.
Expenses not included as part of the participant’s NDIS supports are the responsibility of the Participant and the Participant representative and are not included in the cost of the supports.
Provider Responsibilities as your service provider
The Provider will:
· Provide Plan Management services to the amount funded by your NDIS Plan and agreed in Schedule 1.
· Pay your providers for the supports you purchase.
· Provide you with monthly statements to help you track of your NDIS funds.
· Communicate openly, honestly, professionally and in a timely manner.
· Treat the participant and participant’s representative with courtesy and respect.
· Protect the Participant’s privacy and confidential information.
· Provide supports in a manner consistent with all relevant laws, including the National Disability Insurance Scheme Act 2013 and the Australian Consumer Law. Keep accurate records on the supports provided to the Participant.
· Give the participant information about managing any complaints or disagreements.
· Listen to the participants feedback and resolve problems quickly.
Responsibilities of the Participant/ Participants Representative
The Participant/ Participant Representative agrees to:
· Nominate the provider as your Plan Manager and advise their service providers accordingly.
· Inform the provider about how they wish the supports to be delivered to meet the Participants needs.
· Treat the provider with courtesy and respect.
· Talk to the provider if the participant has any concerns about the supports being provided.
· Provide feedback to the provider to ensure our services continue to meet your needs.
· Tell us immediately if your NDIS plan has been suspended, replaced or you stop being a participant in the NDIS.
· Pay for services that are not included in your NDIS plan. Example of those expenses are services or equipment in excess of the support funded by the NDIS.
Payments
The provider will seek payment for their provision of support directly from the NDIA and a copy of the invoice will be forwarded to you at the end of the month.
Changes to the Service Agreement
If changes to the supports or their delivery are required, the parties agree to discuss and review this Service Agreement. The parties agree that any changes to this service Agreement will be in writing, signed and dated by both parties.
Ending this Service
Should either party wish to end this Service Agreement they must give a 28-day notice in writing. If either Party seriously breaches this Service Agreement the requirement of notice will be waivered.
Feedback, Complaints and Disputes
The provider welcomes your feedback and has a complaint policy to ensure that your concerns are addressed.

If your complaint or dispute is not resolved to your satisfaction you can contact the NDIS Quality and Safeguards Commission by calling 1800 035 544.
GST - Goods and Services Tax
For the purposes of GST legislation, the Parties confirm that: a supply of supports under this Service Agreement is a supply of one or more of the reasonable and necessary supports specified in the statement included under subsection 33(2) of the National Disability Insurance Scheme Act 2013 (NDIS Act), in the Participant’s NDIS plan currently in effect under section 37 of the NDIS Act. On this basis the services provided by Planit under this service agreement shall be deemed to be GST free.
GST may be payable on other support Services provided to the participant even if that provider is not registered service provider with the NDIA. If so, the GST payable will be funded by the participants plan.
Terms and Conditions of our Service
Planit information is provided in good faith, to the best of our knowledge and considered to be correct at the time of communication, however changes may affect this accuracy therefore Planit Plan Managers give no assurance as to the accuracy of any information or advice given.
Any advice given by Planit Plan Managers outside of plan management advice shall be considered general in nature, Planit Plan Managers shall not be liable for any failure or delay in the performance of this service agreement for the period that such failure or delay is:
a. Beyond the reasonable control of a party
b. Materially affects the performance of any of its obligations under the agreement and
c. (e.g., Government Act prohibiting or impending any party from the performing its respective obligations under the Service Agreement contract) or (e.g., Prolonged lack of power supply).
Nothing in the Planit Plan Managers Service Agreement negates or diminishes the statutory guarantees regarding the supply of services the Participant/ representative receive under the Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2)
Planit Plan Managers takes in good faith the information provided by the Participant/ Representative to be true and accurate, and that claims presented by Planit Plan Managers are true reflection of goods and services provided to the Participant in line with the NDIS guidelines (National Disability Insurance Scheme Act 2013).
